Terms of Service

1. Acceptance of Terms

By accessing or using PayDash.ca (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

PayDash is a Software-as-a-Service (SaaS) business operating system for Canadian service-based small and medium businesses. The Service includes invoicing, appointment booking, payment processing, client management, SMS/email communications, and analytics.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must be at least 18 years of age to create an account.

4. Subscription Plans

PayDash offers Starter, Professional, and Business subscription plans. Each plan has defined limits on clients, invoices, SMS messages, and features. Plans are billed monthly or annually in Canadian Dollars (CAD). All prices are exclusive of applicable taxes.

5. Free Trial

New accounts receive a 3-month free trial of the Professional plan. No credit card is required for the trial. At the end of the trial, you must subscribe to continue using the Service. If you do not subscribe, your account will be placed in read-only mode.

6. Payments and Billing

Subscription payments are processed via Stripe. SMS overages beyond your plan allowance are billed at the current per-message rate (configurable by the platform). You authorize PayDash to charge your payment method for recurring subscription fees and any applicable overages.

7. Platform Fees

PayDash charges a platform fee on payments processed through Stripe Connect. The fee varies by plan (3.5%, 2.9%, or 2.4% + $0.30 per transaction). Stripe’s processing fees are separate and charged directly by Stripe.

8. Data Ownership

You retain ownership of all data you enter into PayDash, including client records, invoices, and bookings. PayDash acts as a data processor on your behalf. You are responsible for obtaining necessary consents from your clients for data collection and SMS communications under CASL.

9. CASL Compliance

You agree to use PayDash’s SMS features in compliance with Canada’s Anti-Spam Legislation (CASL). You must obtain express consent from clients before sending commercial electronic messages. PayDash provides tools for consent tracking but you are ultimately responsible for compliance.

10. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to access another organization’s data
  • Reverse engineer or decompile the software
  • Send unsolicited SMS messages through the platform
  • Exceed reasonable usage patterns that degrade service for others

11. Cancellation

You may cancel your subscription at any time from your billing settings. Upon cancellation, your account enters read-only mode at the end of the current billing period. You may export your data before it is permanently deleted after 90 days.

12. Limitation of Liability

PayDash is provided “as is” without warranties of any kind. PayDash is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

13. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be resolved in the courts of Ontario, Canada.

14. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service constitutes acceptance of the updated terms.
